It is mutually agreed that the following terms of agreement form an integral part of this contract and that no variation or modification of this contract shall be effective unless accepted by both David Thorpe Photography and the Client, in writing.

Booking Fee:
  • A fee of £25.00 is required at the time of booking in order to reserve the appointment unless otherwise confirmed by David Thorpe Photography. Payment may be paid by cash, cheque or bank transfer. Please make cheques payable to David Thorpe.
Payment:
  • Payment for all items ordered must be made at the time of ordering. Prices for prints, digital images and canvases are available on our website.
Post & Packaging:
  • The post & packing charges are as listed on the website at the time of booking.
Creative Licence:
  • David Thorpe Photography shall be granted creative and artistic licence in relation to the choice of locations and poses used. David Thorpe Photography’s judgement on photographic style and the number of photographs taken shall be deemed correct. Some photographs may not be possible due to changes of the weather and the availability and willingness of subjects. David Thorpe Photography will do his best to honour requested photographs but do not undertake to guarantee any specific picture nor incorporate any specific background, location or group arrangement.
Copyright:
  • The 1998 Copyright, Designs, and Patents Act assigns copyright to David Thorpe Photography. You may not copy the photographs taken under this contact, or allow copies to be made photographically, electronically, or by any other means. This is a standard condition for professional photographers.
Force Majeure:
  • In the unlikely event of total photographic failure, injury or sickness beyond David Thorpe Photography’s control, their liability shall be limited to a full refund of all monies paid. Your statutory rights are not affected. David Thorpe Photography has full Public Liability and Professional Indemnity Insurance.
Cancellation:
  • If David Thorpe Photography has to cancel the appointment for reasons beyond their control (death, injury, sickness, etc.), their liability shall be limited to a full refund of all monies paid. If the Client cancels the appointment an unconditional refund policy exists up until 7 days prior to the reserved slot at which point the full Booking Fee will be retained by David Thorpe Photography.
Postponement:
  • Should the cancelled appointment turn out to be a postponement, then, subject to David Thorpe Photography’s availability, all monies paid may be applied to the new appointment. In this case, the total fees chargeable shall be the fee which applies at that time. In the event that David Thorpe Photography take another appointment for your cancelled or postponed date, a full unconditional refund of your deposit and monies paid shall be made. If, following cancellation by the client, a new date cannot be agreed by both parties, the full booking fee will be retained by David Thorpe Photography.
Postponement Due To Adverse Weather:
  • If the appointment has to be cancelled by David Thorpe Photography due to adverse weather conditions a new, mutually agreed appointment will be made. However, if the Client would like a Booking Fee refund, this will be granted.
Complaints Procedure:
  • Please address any complaints to David Thorpe Photography by email or writing as per our contact details. We will endeavour to respond to any complaint within 2 working days of receipt.

PRIVACY The Reportage Company will store your name and address details on a private internal database. These details will not be made available to third parties. Should you wish to have your details removed from our database, please advise us in writing.

In the following terms & conditions “the photographer” shall mean David Thorpe trading as David Thorpe Photography. “The client(s)” shall be those persons defined as bride and groom on the booking form. These terms & conditions cannot be varied in any way by the client(s) unless such conditions are expressly agreed by the photographer in writing.

1. Copyright:
  • The copyright Designs and Patents Acts assign the copyright of the images to the photographer.
2. Display:
  • The client(s) hereby allow(s) the photographer to display any photograph covered by this contract and to generally promote the business in advertising, brochures, magazine articles, websites, sample albums etc.
3. License, Coverage and Reproduction:
  • Photographs taken during the course of the event will be at the discretion of the photographer although every effort will be made to comply with the clients requirements.
  • The photographer shall be granted artistic license in relation to the poses photographed and the locations used. The photographer's judgement regarding these matters shall be deemed correct.
  • The photographer shall endeavour to photograph all individuals as requested by the client(s) at some point, but no responsibility will be taken by the photographer on the occasion of leaving somebody out.
  • For a booking involving a church ceremony or at certain venues, the photographer's movements are sometimes restricted by the official in charge. The area from which the photographer is able to cover the ceremony may not be the photographer's choice and the photographer cannot accept responsibility for any obstructed view should this be the case.
  • Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs.
  • Although all equipment is checked regularly and reasonable steps are taken to ensure backup equipment is available, the photographer will not be responsible for photographs that are not produced due to technical failure.
4. Prices:
  • All standard wedding packages and additional goods specified on the booking form are supplied at the prices ruling on the date of booking. Goods not specified on the booking form are supplied at the prices ruling at the time of receipt of the order.
5. Payments:
  • A 20% non-refundable booking fee will confirm your booking, as well as full acceptance of the terms and conditions as published on the photographer's website. The booking fee will be deducted from the cost of the client's chosen package when calculating the final balance due.
  • Payment in full of the remaining balance will be due 21 days before the wedding day.
  • Additional goods ordered must be paid for in full at the time of ordering.
  • Titles to all goods remains with the photographer until paid for in full by the client(s)
6. Force Majeure:
  • The photographer will endeavour to put the client(s) in touch with another photographer in the event they are unable to attend on the wedding date due to any cause beyond their reasonable control e.g. sudden illness, injury, victim of crime, flooding etc.
  • In the event of cancellation by the photographer, or in the very unlikely event of total photographic failure, liability shall be limited to a full refund of any fees paid.
7. Ownership:
  • All digital negatives (computer files) remain the property of the photographer. On occasion, the photographer may supply a copy of the edited digital negatives to the client(s) for their own non-commercial use.
8. Cancellation Fees:
  • If the client(s) should have to cancel a booking the following cancellation fees will become due immediately upon said cancellation:
  • Cancellation from the booking date and more than three months to go until the wedding, the booking fee of £300.00.
  • Cancellation with less than three months to go until the wedding date, full price for the complete photographic coverage booked. Where no package has been specified on the booking form, it will be deemed that the client(s) have chosen a package to the value of £995.00. The client(s) are hereby advised to take out an appropriate insurance policy to cover any expenses incurred in the event of cancellation.
  • Where the photographer is able to re-book the date with an equivalent booking then the cancellation fee will be reduced to the booking fee.
9. On The Day & Optional Evening Cover
  • The photographer is the only authorised and official photographer for your wedding day. The latest the photographer will work to on any wedding day is 11pm. A meal for the photographer must be provided if evening coverage is requested.
10. Optional Pre-Wedding Shoot with Signature Board
  • The pre-wedding shoot (PWS) is undertaken at a mutually convenient location within a fifty mile radius of St Ives Cambridgeshire, or addition mileage expenses would be payable.
  • The photographer accepts no responsibility whatsoever for damage caused to/by the signature board during the wedding day. The signature board is supplied “as is” and all use is at the client's own risk.
11. Personal Accident:
  • Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
12. Album Delivery:
  • All wedding albums are collected or posted to the customer at extra cost.
